The overall objective of this research is to determine the religious perceptions and its levels of university youth and to interpret the findings from the point of view of their psychological features. This research consists of four chapter. These are: introduction, first chapter consist of discussions of the basic concepts such as religiosity, spirituality, second chapter that the data obtained from the survey was assessed the relationships with hypotheses and conclusions in which the findings were interpreted. The study’s population consists (...) of the students at the undergraduate level in faculties of the Erciyes University in 2011-2012. A questionnaire was administered on 553 students, chosen randomly in this population. The survey contains descriptive and Likert style items. As independent variables in this study, branches of science, faculty, department, class, age, gender, living environment for the longest time before coming to university, graduated high school, mother's and father's education level and the accommodation place during training have been taken. When analyzing the data, percentages, frequency distributions, descriptive statistics, analysis of variance (one-way ANOVA) and T-Tests and Chi-Square (x²) techniques were used. As a result of this research hypotheses associated with gender, age, branches of science, faculty and department were confirmed on the other hand the others were rejected. (shrink)

This article presents the new German law on advance directives from 1 September 2009. The history of the parliamentary process of this law is described, the present regulations are explained, their relevance for medical practice discussed and shortcomings are identified. Finally, the new law is compared with other regulations in the international context. Previously established legal practice in Germany has now become largely confirmed by the new law: An advanced directive must be respected in any decision concerning medical treatment, regardless (...) of the stage of the illness. It can be informally revoked at any time, even with limited decision-making capacity. Nobody may be obliged to issue a directive in any way. Advance directives do not need notarisation or routine updating after certain time intervals. Provided that the patient, who is no longer mentally competent, has issued a lasting power of attorney, or provided that the patient has been appointed a healthcare proxy by the courts, this authorised surrogate must assert the patient's will. The role of the guardianship court is clarified: it only needs to be involved in cases of disagreement as to the patient's will. The new German law thus combines more legal certainty with a liberal emphasis on patient autonomy and flexible, adaptable regulations. (shrink)

This paper examines the deontic logic of the Talmud. We shall find, by looking at examples, that at first approximation we need deontic logic with several connectives: O T A Talmudic obligation F T A Talmudic prohibition F D A Standard deontic prohibition O D A Standard deontic obligation. In classical logic one would have expected that deontic obligation O D is definable by $O_DA \equiv F_D\neg A$ and that O T and F T are connected by $O_TA \equiv F_T\neg (...) A$ This is not the case in the Talmud for the T (Talmudic) operators, though it does hold for the D operators. We must change our underlying logic. We have to regard {O T , F T } and {O D , F D } as two sets of operators, where O T and F T are independent of one another and where we have some connections between the two sets. We shall list the types of obligation patterns appearing in the Talmud and develop an intuitionistic deontic logic to accommodate them. We shall compare Talmudic deontic logic with modern deontic logic. (shrink)

Supervenience is one of the 'hot discoveries' of analytic philosophy, and this collection of essays on the topic represents an examination of it and its application to major areas of philosophy. The interest in supervenience has much to do with the flexibility of the concept. To say that x supervenes on y indicates a degree of dependence without committing one to the view that x can be reduced to y. Thus supervenience is a relationship that has the potential of replacing (...) the traditional notion of dependence, while performing at least part of the function reductive relationships were supposed to fulfil. Knowledge can be expressed in language using a plethora of grammatical means. Four major groups of meanings related to knowledge are Evidentiality: grammatical expression of information source; Egophoricity: grammatical expression of access to knowledge; Mirativity: grammatical expression of expectation of knowledge; and Epistemic modality: grammatical expression of attitude to knowledge. The four groups of categories interact. Some develop overtones of the others. Evidentials stand apart from other means in many ways, including their correlations with speech genres and social environment. The legacy of colonial rule has permeated into all aspects of life and contributed to healthcare inequity. In response to the increased interest in social justice, medical educators are thinking of ways to decolonise education and produce doctors who can meet the complex needs of diverse populations. This paper aims to explore decolonising ideas of healing within medical education following recent events including the University College London Medical School’s Decolonising the Medical Curriculum public engagement event, the Wellcome Collection ’s Ayurvedic (...) Man: Encounters with Indian Medicine exhibition and its symposium on Decolonising Health, SOAS University of London’s Applying a Decolonial Lens to Research Structures, Norms and Practices in Higher Education Institutions and University College London Anthropology Department’s Flourishing Diversity Series. We investigate implications of ‘recentring’ displaced indigenous healing systems, medical pluralism and highlight the concept of cultural humility in medical training, which while challenging, may benefit patients. From a global health perspective, climate change debates and associated civil protests around the issues resonate with indigenous ideas of planetary health, which focus on the harmonious interconnection of the planet, the environment and human beings. Finally, we look further at its implications in clinical practice, addressing the background of inequality in healthcare among the BAME populations, intersectionality and an increasing recognition of the role of inter-generational trauma originating from the legacy of slavery. By analysing these theories and conversations that challenge the biomedical view of health, we conclude that encouraging healthcare educators and professionals to adopt a ‘ decolonising attitude ’ can address the complex power imbalances in health and further improve person-centred care. This study will examine how Dāvūd al-Qarṣī, an 18th-century Ottoman scholar, resolved the paradox between human freewill and God being the creator of everything in his work Risālâh fi’l-ikhtiyārāt al-juzʾiyyah wa’l-irādāt al-qalbiyyah. In addition, in this study, the critical edition and translation of the risālah will also be provided. The treatise which is the subject of the present study is a link in the series of works written under the title of human acts in the Islamic thought tradition regarding al-irādah (...) al-juzʾiyyah, afʿāl al-ʿibād, khalq al-aʿmāl, qaḍā, and qadar. This risālah is one of the rare examples prepared with the method of “mamzūj annotation (sharḥ)”, which is a method in which “text” and “annotation” are intertwined. Qarṣī examines in detail a total of seven views, four of which are famous (mashhūr) and three of which are non-famous, about voluntary acts. Qarṣī interprets the approaches and views of the non-famous sects and includes them in the famous sects and allocates approximately 4/3 of the work to these sects. In the final stage of the work, the author states that the view of Māturīdīs is parallel with the predecessor’s (Salaf) view of “Neither jabr nor tafwīḍ; rather, it is merely a situation between these two approaches.” Qarṣī, who was inspired by Athīrī Maḥmad Afandī (d. 1092/1681), says that voluntary acts come about by the sum of “two powers (qudrat)”, “two wishes (mashīʾat)” and “one taqwīn”. Also, according to this, the first four of them are proximate causes, while the attribute taqwīn is the influencing factor. Qarṣī acts from the meanings of the term action (fiʿl) and the “theory of state (ḥāl)” in order to prove that human beings are true agents (fāʿil) on the one hand and to protect God’s attribute of creation on the other. In fact, the concept of “state (ḥāl)”, used in understanding divine attributes and some ontological issues, was applied to acts by the Māturīdī mutakallim Ṣadr al-Sharīʿa al-Thānī (d. 747/1346). Thus, a doctrine of action was developed, and this doctrine was accepted and used by the later period Māturīdī mutakallims. With reference to Ṣadr al-Sharīʿa, Qarṣī tries to justify the issue based on the meanings of the the term action and the modes of existence of these meanings. He says that action has two implications; one of them is the “infinitive meaning” (al-maʿnā al-maṣdarī) and the other is “the thing that comes with this infinitive meaning (al-ḥāṣıl bi-maṣdar)”. The infinitive meaning of the act constitutes the “non-thing aspect” of the action, and the meaning of the action that is created with the infinitive indicates “the thing aspect” thereof. Thus, because the aspect of the action that is not existentand therefore not a thing is not subject to creation, the agency and responsibility of human beings are grounded. Similarly, Qarṣī maintains that the mashīʾat, which means will, qaṣd and al-irādah al-juzʾiyyah, was not created because its existence in humans is in the form of succession and it is of a state-like (ḥāl) existenceOn this account. Qarṣī manages to preserve both human freewill and the absolute creativity of God due to the non-existent and non-thing aspect of the act on the one hand, and will (irādah), mashīʾat and qaṣd not being subjected to creation on the other. Progressive supranuclear palsy is a movement disorder with prominent tau neuropathology. Brain diseases with abnormal tau deposits are called tauopathies, the most common of which is Alzheimer's disease. Environmental causes of tauopathies include repetitive head trauma associated with some sports. To identify common genetic variation contributing to risk for tauopathies, we carried out a genome-wide association study of 1,114 individuals with PSP and 3,247 controls followed by a second stage in which we genotyped 1,051 cases and 3,560 controls for the (...) stage 1 SNPs that yielded P ≤ 10-3. We found significant previously unidentified signals associated with PSP risk at STX6, EIF2AK3 and MOBP. We confirmed two independent variants in MAPT affecting risk for PSP, one of which influences MAPT brain expression. The genes implicated encode proteins for vesicle-membrane fusion at the Golgi-endosomal interface, for the endoplasmic reticulum unfolded protein response and for a myelin structural component. © 2011 Nature America, Inc. It is known that the science of recitation is one of the important branches of Islamic sciences in terms of its subject. It is stated that the science of recitation is intertwined with the Qurʾān and has an important place in terms of tafsīr, ḥadīth and law sciences. In this respect, it is understood that the recitation of Yaʿqūbis one of the ten sound recitations accepted as authentic and mutawātir (Consecutive). Although there are comparative works in whichYaʿqūb's recitation is mentioned (...) together with other recitations, it is striking that there is no study in whichYaʿqūb's recitation is handled separately. In this study, it is aimed to clarify the issues in Yaʿqūb’s recitation, even though they are not in other recitations. It is understood that Yaʿqūb’s recitation has some differences compared to other recitations and contains some unique features. In this respect, these issues specific to Yaʿqūb reading are frequently encountered in dictionaries and tafsīr sources. In this article, it is planned to evaluate the recitation of Yaʿqūb in two parts. In the first chapter, the procedural rules of Yaʿqūb recitation are given and the subjects are explained with the sampling method. In the second part, attention is drawn to the points where Yaʿqūb recitation differs from other recitations. What is meant by the rules of procedure in the science of recitation is the set of general rules that take place when conditions such as madd, qasr, izhār, idghām and iqlāb are met. Farsh, recitation on the other hand, is the different reading of certain words independent of these rules. There are different views on the reading of the pronoun hā, which is evaluated within the framework of the rules of procedure. Recitation imams state that it is controversial whether the pronoun hā in the dual and plural pronouns which comes after the silent letter, can be read with damma (u sound) or kasrah (i sound). When the recitation of Ya'qūb is examined, it is understood that all pronouns of this type are read with damma and this view is preferred. It is stated that there is no consensus on the use of the letter mīm, which is a sign of plurality with kasrah or damma. In this regard, Ya'qūb subordinates the letter mīm to the letter hā, Where the letter hā is pronounced damma, it reads the letter mīm as damma, and where the letter hā is pronounced as damma, it reads the letter mīm with kasrah and does not go beyond this limit. Idghām, which is used as a concept in the science of recitation, is the combination of two letters that are mutamasil, mutaqārib or mutajānis, transforming them into a single letter and forming it. It is stated that Abu 'Amr was the imam of the recitation, who practiced İdghām-ı kabir, which is one of the important subjects of the science of recitation and tajwīd (the rules of recitation), and that Ya'kūb came later. It is seen that some recitation imams on the subject of waqf (stopping) did not make any changes regarding the words dedicated on it, by complying with the way it was written in the musḥaf (the Qur’ān). However, it is striking that there are some changes in the recitation of Ya'qūb. As a concept used in the science of recitation, farsh is the reading of the words in the Qur'ān in different ways by the recitation imams and attributing each recitation to its owner. Therefore, these differences take place in all recitations and this subject is also known as Farshu'l-Khurūf or al-Furū'. When we look at the difference between farsh and usūl in the science of recitation, it is seen that the usūl is realized within the framework of certain rules, while the farsh is formed independently of these rules. The subject of general utterances (al-lafdh al-āmm) being certain or presumptive in their usage as an indication to all their members is controversial amongst the methodists. Ḥanafī methodists suggest that the indication of general utterances to all of their members as certain and unless they are specified with a certain evidence, they can’t be specified with a presumptive evidence. Like the ḥanafī methodists, the ẓāhirī methodists also suggest that the general utterance is certain indicant for all of its members and (...) can be specified only with another evidence in the same rank. The main difference between the two groups focuses on whether al-khabar al-wāhid (single prophetic narration) is a certain or a presumptive evidence in terms of certitude. According to ḥanafīs, al-khabar al-wāhid is a presumptive evidence and unless the general utterances in Qur’ān are specified initially with another certain evidence, they can’t be specified with al-khabar al-wāhid. However, al-khabar al-wāhid is a certain evidence according to ẓāhirīs and it can specify general utterances in Qur’ān. In this study, the comparison of the views of the methodists of two schools regarding the indication of general utterances in Quran and their specification (takhsīs) with al-akhbar al-wāhid is made and their influence on Islamic Law regulations is studied afterwards. In this study, the two sect’s approaches are compared over the provision of reading al-Fatehah during prayer, the number of milk sucking to establish the kinship, the rights of women divorced with bain talaq and the execution of the death penalty in the Harem region.Summary: The purpose of this study is to try to demonstrate that an assertion in the Ph.D. thesis, The History and Doctrine of Ẓāhirī Madhhab, completed by Amr Osman in 2010 is incorrect. It can be summarized that in his study, Amr Osman claims that the affiliation of the schools to ahl-al-hadith and ahl-al-ra’y in conventional classification is wrong. According to him, contrary to what is known, the School of Ẓāhiriyya is closer to School of Ḥanafiyya rather than schools coming out of ahl-al-hadith. In this study, one of the arguments that he relied on to support his claim is studied in order to prove that his claim was inaccurate. Osman claims that ẓāhirīs are closer to ḥanifīs, based on the view that in both schools the general utterances embrace all of their members in their usage and they are a certain indicant to all of their members. At this stage, although the views of both schools are common, the ḥanifīs don’t accept the idea that the general statements of Qur’ān can be established with al-khabar-al-wāhid, those which they acknowledge as presumptive as of certitude. However, according to the ẓāhirīs, the certitude of al-khabar al-wāhid is as precise as the narrated report, so it can specify the general statements of Qur’ān which are in equal power. The related dispute between the schools has been reflected on many Islamic law regulations. Some of them are:1. Ḥanafīs state that the correct Quranic prayer may be performed by reading any or a few verses of the Qur’ān in prayer, which is a practice based on the verse “Read what you can read from the Qur’ān now”. On the other hand, the ẓāhirīs have established the related order based on the report “There is no prayer without reading Umm Al-Quran (Surah al-Fatehah)” and it is obligatory (fardh) to read Surah al-Fatehah in prayers.2. Because that the terms milk-mother and milk sister are in general form in the verse “It is forbidden to you to marry these people...Your milk-mothers who nursed you, your milk-sisters who nursed you” the ḥanafīs clarify that it is sufficient for a child to breastfeed only one time in order to form a milk-kinship. They do not act in accordance with the solitary report (al-khabar-al-wāhids) which indicate that the milk kinship specifying the verse shall only be formed with at least three or five breastfeeding. However, one of the ẓāhirīs, Dāwūd al-Ẓāhirī, has specified the verse with the report indicating that the kinship shall not be formed with less than three breastfeeding by the child, and Ibn Ḥazm has specified it with Salim hadith which indicates that the kinship shall be formed with five breastfeeding.3. According to ḥanafīs, there is an alimony and inhabiting right of the widow woman to be procured by the husband within the period of delay who divorced her either with irreversible divorce (talāq al-bāin) or reversible divorce (talāq al-ric‘ī) according to the generalization of the verse “Give shelter to them (the women you have divorced) in some part of your household within your capacity.” They did not act with the report of Fātima binti Qays, who specified the generalization of the verse. On the other hand, the ẓāhirīs recognize the abovementioned rights only for the women who got divorced with irreversible divorce or the ones who are pregnant, specifying the verse with the report indicating that His Holiness the Prophet does not grant alimony and inhabiting to the woman who was divorced with reversible divorce.4. According to ḥanafīs, the criminal who committed a crime that would require a death penalty and took refuge in the Harem region could not be executed while in Ḥarem, according to the common statement of the verse, “Whoever enters there, will be safe.” Dāwūd al-Ẓāhirī, one of the ẓāhirīs has specified the verse with the report indicating that His Holiness the Prophet has authorized the execution of the sentence to Ibn Khattal in Ḥarem on the day of the conquering of Mecca and he states that the death sentence can be executed wherever the criminal is caught, even if it is inside the Harem. Ibn Ḥazm shares the same view with ḥanafīs regarding the provision of this issue. However, the reason for his opinion stems from the fact that the report about Ibn Khattal was an event specific to that day. As it is seen, even though the ḥanefīs and ẓāhirīs share the same opinion about the general utterances being a certain indicant to all their members, they have disagreements upon the argument about the general utterances of Quran being specified by al-khabar al-wāhid and many Islamic Law regulations have been issued by these schools based on such disagreements. According to us, in the final analysis, Amr Osman’s claim must be met with caution. (shrink)

Objectives To conduct an independent evaluation of the first phase of the Health Foundation’s Safer Patients Initiative (SPI), and to identify the net additional effect of SPI and any differences in changes in participating and non-participating NHS hospitals. Design Mixed method evaluation involving five substudies, before and after design. Setting NHS hospitals in the United Kingdom. Participants Four hospitals (one in each country in the UK) participating in the first phase of the SPI (SPI1); 18 control hospitals. Intervention The SPI1 (...) was a compound (multi-component) organisational intervention delivered over 18 months that focused on improving the reliability of specific frontline care processes in designated clinical specialties and promoting organisational and cultural change. Results Senior staff members were knowledgeable and enthusiastic about SPI1. There was a small (0.08 points on a 5 point scale) but significant (P<0.01) effect in favour of the SPI1 hospitals in one of 11 dimensions of the staff questionnaire (organisational climate). Qualitative evidence showed only modest penetration of SPI1 at medical ward level. Although SPI1 was designed to engage staff from the bottom up, it did not usually feel like this to those working on the wards, and questions about legitimacy of some aspects of SPI1 were raised. Of the five components to identify patients at risk of deterioration—monitoring of vital signs (14 items); routine tests (three items); evidence based standards specific to certain diseases (three items); prescribing errors (multiple items from the British National Formulary); and medical history taking (11 items)—there was little net difference between control and SPI1 hospitals, except in relation to quality of monitoring of acute medical patients, which improved on average over time across all hospitals. Recording of respiratory rate increased to a greater degree in SPI1 than in control hospitals; in the second six hours after admission recording increased from 40% (93) to 69% (165) in control hospitals and from 37% (141) to 78% (296) in SPI1 hospitals (odds ratio for “difference in difference” 2.1, 99% confidence interval 1.0 to 4.3; P=0.008). Use of a formal scoring system for patients with pneumonia also increased over time (from 2% (102) to 23% (111) in control hospitals and from 2% (170) to 9% (189) in SPI1 hospitals), which favoured controls and was not significant (0.3, 0.02 to 3.4; P=0.173). There were no improvements in the proportion of prescription errors and no effects that could be attributed to SPI1 in non-targeted generic areas (such as enhanced safety culture). On some measures, the lack of effect could be because compliance was already high at baseline (such as use of steroids in over 85% of cases where indicated), but even when there was more room for improvement (such as in quality of medical history taking), there was no significant additional net effect of SPI1. There were no changes over time or between control and SPI1 hospitals in errors or rates of adverse events in patients in medical wards. Mortality increased from 11% (27) to 16% (39) among controls and decreased from 17% (63) to 13% (49) among SPI1 hospitals, but the risk adjusted difference was not significant (0.5, 0.2 to 1.4; P=0.085). Poor care was a contributing factor in four of the 178 deaths identified by review of case notes. The survey of patients showed no significant differences apart from an increase in perception of cleanliness in favour of SPI1 hospitals. Conclusions The introduction of SPI1 was associated with improvements in one of the types of clinical process studied (monitoring of vital signs) and one measure of staff perceptions of organisational climate. There was no additional effect of SPI1 on other targeted issues nor on other measures of generic organisational strengthening. (shrink)

The text of “The Four Premises” (Muqaddimāt al-Arba‘a), which began with Sadr al-Sharī‘ah (d. 747/1346), centralizes on the actions of human beings by connecting it with the problem of good and evil in the field of kalām, Islamic philosophy and logic, and fıqh. It was also commented in with incisive and critical footness by Sa‘d al-Dīn al-Taftāzānī (d. 791/1390). In Ĥāshiya ‘alā Muqaddimāt al-Arba‘a, al-Kastalī (d. 901/1496) discusses the two main issues. One of them is good/husn-evil/qubh, the other is human (...) actions. Good-evil dichotomy here is axiological, whereas the human actions are examined within an ontological structure. The quest for the origin of moral values is a husn-qubh debate. Identifying the hierarchy of human actions in ontology is another problem. The main purpose of this study is to investigate the theological discussions in the Ĥāshiya ‘alā Muqaddimāt al-Arba‘a which were written following the order of Sultan Mehmed the Conqueror/Fatih. This text addresses the origin of moral judgment and the question of freedom and destiny in human actions linked to the problem of good and evil. Discussing these two fundamental issues, has made it necessary to thoroughly investigate perhaps all the subheadings which concern the entire paradigm that falls under the framework of understanding the God, nature, and humanity. By looking at the treatise, the main sources of the issues being discussed are mostly generated from an Islamic jurisprudence works, entitled Tawḍīḥ and Talwīḥ. It can easily be discerned that the direct quotations that were made or taken indirectly were from these two sources. References to other sources were quite seldom. However, the excerpts that were taken from primary sources were interpreted and expounded by the author and amended anew. In this article al-Kastalī’s comments will be analyzed. He’s work Ĥāshiya ‘alā Muqaddimāt al-Arba‘a will be analyzed in depth and will be published for the first time with a critical edition. Text of Muqaddimāt al-Arba‘a is a product of a culture of criticism and critical thinking has two foundations: Disproval and verification. Critical thinking is then bidirectional. It is wrong to carry out the criticism activity in only one direction. It is insufficient to simply refute the opposing idea. It is not enough to show the wrong. The so-called right idea also needs to be justified. In the Tawdīh, Sadr al-Sharī‘ah criticizes al-Ashʿarī in the issues of husn-qubh and human actions. According to this criticism, good and evil should be based on the reason. On the other hand, human is free in his actions. As it is known, goodness and badness was based on religion according to al-Ashʿarī. Acquisition (kasb) given to man was unclear. It is al-Taftāzānī who wrote an annotation on Tawḍīḥ with the name of Talwīḥ. He’s comments are successful in terms of theology. However, these interpretations do not mean that he accepted the Muqaddimāt al-Arba‘a. In terms of al-Taftāzānī, proofs of Sadr al-Sharī‘ah is weak. The theological disputes in Tawḍīḥ and Talwīḥ have reached the level of tension in the following works. The origins of the divergence are based on the differentiation between the schools of al-Māturīdi and al-Ashʿarī. In fact, these schools are not different from each other in terms of the method they use. Although the roads walked were the same, the results achieved were different. The main reason for this is that the issue is ambiguous and the problem of good and evil is multidimensional. It is directly related to God and human. It is also connected with ontology and epistemology together. The position on the husn-qubh issue is also decisive for other theological problems. The root of the evil problem or theodicy is mostly based on this problem in Islamic thought. The actions of God and human are questioned here. The value judgments that actions will take are examined. Which action is more moral and better? Another major problem discussed in this article is human actions. It is a matter of freedom of human volition. The volition of man before the absolute God is a problem. Because God has absolute power, will and knowledge. On the other hand, God imposes responsibility on man. But what are the limits of this responsibility? Al-Kastalī discusses all these problems in the context of Sadr al-Sharī‘ah and al-Taftāzānī. In the big picture there are representatives of the schools of al-Māturīdi and al-Ashʿarī. Al-Kastalī doesn’t paint a new picture, rather makes the lines in the picture clear. In this article, the texts will be analyzed mutually. The content and uses of the concepts will be given importance. This study discusses the treatise of Jalāl al-Dīn Davvānī (d. 908/1502) named Risāla fī taʻrīf ʻilm. This treatise criticizes a definition of knowledge adopted by some theologians in the late period (mutaʾakhkhirīn). The definition of knowledge at issue consists of three components: Attribution, discernment, no possibility of contradiction. Knowledge is an attribute as a category and with this attribution, a discernment is obtained. As a result of this process knowledge is acquired and there should be no possibility of this knowledge (...) to be inconsistent. Davvānī examines eight possibilities of the definition on knowledge. In each of these eight possibilities a different problems arises. According to Davvānī, the definition mentioned is problematic in all probability. Nonetheless, Davvānī does not propose another definition of knowledge that can replace the definition of knowledge that he criticizes. This article represents the process of reaching the definition of knowledge stated in the history of theological thought. The definitions on knowledge made from the first period (al-mutaqaddimīn) are summarized and the strengths and weaknesses of these definitions are explained. There are two main approaches regarding the nature of knowledge in Islamic thought: According to the first approach pioneered by Fakhr al-Dīn Rāzī (d. 606/1202), absolute knowledge is a priory (badīhī) and undefinable. According to the second one, the nature of absolute knowledge is a posteriori (naẓarī) and definable. The first part of this article includes the definitions and criticisms of knowledge in Islamic thought. The second part discusses the claim of originality. In the second part, Davvānī’s treatise will be evaluated for the first time. According to the conclusion of the treatise, the definition made to find the essence of knowledge is unfounded in all respect. It is important to evaluate the treatise as a reflection of anti-essentialism in the history of Islamic thought. Most contemporary studies do not count this treatise among Davvānī’s works. In the biography book al-Aʿlām written by Khayr al-Dīn al-Ziriklī (d. 1976), Risāla fī taʻrīf ʻilm is counted among the works of Davvānī. In the introduction of more than one manuscript, the work is clearly attributed to Davvānī. As a result of the double-sided research, it has been ensured that the work belongs to Davvānī. However, in other two manuscripts containing the same treatise, the work is shown as belonging to an unknown person named Şāirzāda. But there is no information found about this person. This name seems more like a copyist (mustansıh) than an author. Possibly, such a mistake occurred as a result of confusing the two names. Davvānī’s small volume treatise sheds light on the intellectual atmosphere and level of its period. The definition of knowledge mentioned in the classical theology book of ‘Aḍud al-Dīn al-Ījī (d. 756/1355) called al-Mawāqif is superior to other definitions of knowledge. Instead of this definition of knowledge, which is presented as perfect, Jurjānī (d. 816/1413) preferred the definition of knowledge attributed to al-Māturīdī (d. 333/944) in the Sharḥ al-Mawāqif. This preference has been accepted as an implicit criticism for future generations, including Davvānī. Those who claimed that Jurjānī did not taken a random choice, carried on their criticism by going over the definition. The fine craftsmanship revealed in the treatise reveals that critical thinking is used intensively. The properly understanding of the treatise depends on knowing the science of logic and following it with intense attention. The definition of knowledge is examined from various angles with the help of concepts such as conception, ratification, judgment and contradiction (nakz) of the science of logic. In the science of logic, every layer of knowledge such as certainty, conjecture, imitation, doubt is investigated one by one. In the science of kalām, attention is paid that the ideal level of knowledge is precise. An uncertain knowledge is not considered knowledge according to kalām. Because the main goal of theologians is to build religious beliefs on the obtained certain knowledge. It is not accepted to base knowledge to a probable information on imprecise knowledge. For a knowledge among the knowns to reach the level of certainty, it must be correct and exclude other possibilities. Another condition is required for certainty in the definition of knowledge that Davvānī examines in his treatise is that the opposite is wrong. The fact that a piece of information is considered true depends on the fact that its reverse is false. In this treatise, it is discussed how to look for the contradictions or discrepancy that are wanted to be excluded. Knowledge is inseparable from the human mind, from outside of the world, or from the relationship between the two. (shrink)

Today, which is described as the information age, it is expected from schools where knowledge is produced, education-training activities are carried out, and education is realized, to raise a self-confident student profile in accordance with the requirements of this age. The learning climate is important in this regard. Learning climate, which is one of the new components used instead of organizational climate and school climate in the climate literature, includes all kinds of factors related to learning ability; human factors are (...) dealt with in many dimensions, especially the virtual/real spaces where learning takes place, and measurements are made with the tools developed to measure the learning climate. The data obtained is a source for improvement studies. In our study, the school learning climate was discussed in terms of school engagement, learning environment, and communication dimensions. As a type of self-efficacy, one of the basic concepts of Social Cognitive Theory, academic self-efficacy, which expresses the students' self-confidence in subjects that require academic study, can be explained as the individual's ability to use effective cognitive strategies in order to learn, effectively manage their learning environment and learning times, and effectively organize their own performance. Academic self-efficacy is considered by researchers in different dimensions, measurements are made with different scales. In our study, academic self-efficacy was handled in cognitive, social and technical dimensions. The main factors that make people strong in the flow of life are self-confidence, critical perspective, success in social relations; basic skills such as interest in any sporting, artistic or cultural field are possible with the students' gain from the school climate. In this case, we can say that having a good wind at school, creating a livable and lovable atmosphere, and sitting on an original and critical ground is only possible with a positive and sustainable school climate. The school climate, which positively nurtures academic self-efficacy, will bring the success of the human elements affected by the climate. A positive school climate and strong academic self-efficacy will become the greatest means of academic success. Measuring the learning climate, interpersonal relationships, role models, expectations, etc. in schools. It can help to understand the quality of life as well as the success and satisfaction of students. The aim of this study is to examine the relationship between the learning climate perceptions of students of higher religion and their academic self-efficacy and academic achievement. In this framework, four basic research questions have been tried to be answered: (i) What is the level of the learning climate and academic self-efficacy perceptions of higher religious education students? (ii) Is there a significant relationship between higher religious education students' learning climate and academic self-efficacy? (iii) Are the age, learning climate and academic self-efficacy beliefs of higher religious education students significant predictors of their academic achievement? (iv) What are the views of higher religious education students regarding their negative perceptions of the learning climate? The triangulation strategy was used in the study, which was patterned with mixed method and convergent parallel research design. In the quantitative section of this study, Academic Self-Efficacy Scale developed by Owen and Froman and adapted into Turkish by Ekici and the School Climate Scale for University Students, developed by Terzi was applied to 1147 students from six faculties, who study in high religious education in public universities within Turkey. In the qualitative part, interview forms were filled in by 18 students from the same faculties. Test of normality was applied to the quantitative data set obtained after the research conducted in May 2019. Independent Samples t-Test, Mann Whitney U Test, Levene test, One-way Analysis of Variance (ANOVA), Scheffe Test, Kruskal Wallis H Test, Pearson Product-Moment Correlation, Polyserial Correlation and Path Analysis were used to analyze the data. Qualitative data were analyzed by descriptive analysis. According to the results of the research, the perception of the learning climate and also of academic self-efficacy in general was negative for of the students of higher religious education. The correlation between general average of School Climate Scale and Academic Self-Efficacy Perception Scale is at medium level. According to the results of the research, the findings were discussed in the light of the literature, and after the comments, various solution suggestions were presented that are thought to provide a positive learning climate in higher religious education, strengthen the academic self-efficacy of higher religious education students and increase their academic success. We work with weakly precomplete equivalence relations introduced by Badaev. The weak precompleteness is a natural notion inspired by various fixed point theorems in computability theory. Let E be an equivalence relation on the set of natural numbers $$\omega $$, having at least two classes. A total function f is a diagonal function for E if for every x, the numbers x and f(x) are not E-equivalent. It is known that in the case of c.e. relations E, the weak precompleteness (...) of E is equivalent to the lack of computable diagonal functions for E. Here we prove that this result fails already for $$\Delta ^0_2$$ equivalence relations, starting with the $$\Pi ^{-1}_2$$ level. We focus on the Turing degrees of possible diagonal functions. We prove that for any noncomputable c.e. degree $${\textbf{d}}$$, there exists a weakly precomplete c.e. equivalence E admitting a $${\textbf{d}}$$ -computable diagonal function. We observe that a Turing degree $${\textbf{d}}$$ can compute a diagonal function for every $$\Delta ^0_2$$ equivalence relation E if and only if $${\textbf{d}}$$ computes $${\textbf{0}}'$$. On the other hand, every PA degree can compute a diagonal function for an arbitrary c.e. equivalence E. In addition, if $${\textbf{d}}$$ computes diagonal functions for all c.e. The Hubbard model is studied at half filling, using two complementary variational wave functions, the Gutzwiller ansatz for the metallic phase at small values of the interaction parameter U and its analog for the insulating phase at large values of U. The metallic phase is characterized by the Drude weight, which exhibits a jump at the critical point Uc. In the insulating phase the system behaves as a collection of dipoles which increase both in number and in size as U (...) gets smaller. The two wave functions are able to describe the two asymptotic regimes (small and large values of U, respectively), but they can no longer be trusted in the region of the Mott transition (U≈Uc). More powerful methods are needed to study, for instance, the divergence of the electric susceptibility for U→Uc. (shrink)

Despite tremendous investment to promote gender equity, U.S. public accounting firms continue to be gendered organizations. Our archival study examines gender equity within the partnership of these large firms for a one-year period. We find female partners are clustered in lower prestige client types including investment funds, benefit plans, and single audits, rather than higher prestige public company clients. Second, we consider whether there is gender bias in prestige of client served by female partners who lead public company audits. In (...) these tests of those individuals who have already achieved the partnership and lead public company audits, we find no evidence of bias. This research contributes to the understanding of gender bias in U.S. public accounting firms and helps inform the societal narrative on where women continue to be marginalized even when they have achieved the highest levels in an organization. This paper introduces a possible alternative model of gravity based on the theory of fractional-dimension spaces and its applications to Newtonian gravity. In particular, Gauss’s law for gravity as well as other fundamental classical laws are extended to a D-dimensional metric space, where D can be a non-integer dimension. We show a possible connection between this Newtonian Fractional-Dimension Gravity (NFDG) and Modified Newtonian Dynamics (MOND), a leading alternative gravity model which accounts for the observed properties of galaxies and other astrophysical (...) structures without requiring the dark matter hypothesis. The MOND acceleration constant $${a_{0}} \simeq 1.2 \times 10^{-10} \text {m}\, \text{s}^{-2}$$ can be related to a natural scale length $$l_{0}$$ in NFDG, i.e., $$a_{0} \approx GM/l_{0}^{2}$$, for astrophysical structures of mass M, and the deep-MOND regime is present in regions of space where the dimension is reduced to $$D \approx 2$$. For several fundamental spherically-symmetric structures, we compare MOND results, such as the empirical Radial Acceleration Relation (RAR), circular speed plots, and logarithmic plots of the observed radial acceleration $$g_{obs}$$ vs. the baryonic radial acceleration $$g_{bar}$$, with NFDG results. We show that our model is capable of reproducing these results using a variable local dimension $$D\left( w\right)$$, where $$w =r/l_{0}$$ is a dimensionless radial coordinate. At the moment, we are unable to derive explicitly this dimension function $$D\left( w\right)$$ from first principles, but it can be obtained empirically in each case from the general RAR. Additional work on the subject, including studies of axially-symmetric structures, detailed galactic rotation curves fitting, and a possible relativistic extension, will be needed to establish NFDG as a viable alternative model of gravity. In this essay I endeavor to provide such an account, and describe at a pretheoretical level an embodied subjectivity at odds with its own state of embodiment, and on the other hand, to explore the limited agency induced by constraints that fall upon an embodied subject who is compelled to live a body which is free to engage the various possibilities of the world in every respect except one, within the context of an intercorporeal social reality. This description will provide (...) a sound ontological foundation where the central place of embodiment in the abortion debate can be re-asserted and properly taken into account. What this description will reveal is the ontological drama of such “aversely pregnant subjectivities” at a time when ever more legislation is being passed that poses ever more restrictions on reproductive rights of women in the United States. This investigation is all the more pertinent in light of Justice Anthony Kennedy’s recent announcement that he is retiring from the U.S. Supreme Court, which may well put the right to legal abortions in jeopardy. My highest ambition, however, is to convey the significance of these restrictions to those who have never been and never can become pregnant, but who by and large determine the polices that play a substantial role in shaping such subjectivities. The question of providence and contingency in contemporary Western thought: a critical study from an Islamic perspective.

The law within each legal system is a function of the practices of some social group. In short, law is a kind of socially grounded norm. H.L.A Hart famously developed this view in his book, The Concept of Law, by arguing that law derives from a social rule, the so-called “rule of recognition.” But the proposition that social facts play a foundational role in producing law is a point of consensus for all modern jurisprudents in the Anglo-American tradition: not just (...) Hart and his followers in the positivist school, most prominently Joseph Raz and Jules Coleman, but also the anti-positivist Ronald Dworkin, who argues that law necessarily synthesizes moral considerations with social facts. But which group’s practices ground each legal system? In particular, which group’s practices undergird U.S. law? Positivists since Hart have universally pointed to either officials or judges as the “recognitional community” (my term): the group such that its rules, conventions, cooperative activities, or practices in some other sense are the social facts from which the law of a given legal system derives. So Hart and all other positivists would identify either U.S. officials or U.S. judges as the recognitional community for U.S. law. This Article grapples with the tension between the positivist’s official- or judge-centered account of the recognitional community and the “popular constitutionalism” now so widely defended by constitutional scholars such as Larry Kramer, Robert Post, Reva Siegel, Mark Tushnet, Jeremy Waldron, and many others. Surely the popular constitutionalist would want to claim that U.S. citizens, not judges or officials, are the recognitional community for U.S. law. I term this position “deep popular constitutionalism.” Indeed, it turns out that Dworkin’s account of law, in its ambition to generate associative moral obligations for the citizenry as a whole, implies deep popular constitutionalism. Here there is a disagreement, hitherto unnoticed, between Dworkin and the positivists. My solution to this disagreement – to the debate between deep popular constitutionalists and deep official or judicial supremacists -- is to dissolve it by providing a group-relative account of law. Social norms, such as norms of dress or eating, are clearly group-relative. A particular dressing or eating behavior may be socially appropriate relative to one group’s norms, yet socially inappropriate relative to another’s. This Article extends the group-relative view from social norms to law itself, with a particular focus on U.S. law and constitutionalism. Part I surveys the jurisprudential literature. It shows how Hart and successor positivists identify the rule of recognition as a social practice engaged in by officials or some subset of officials (judges), rather than citizens generally, and argues that Dworkin by contrast sees the citizenry as a whole as his recognitional community. Parts II and III defend a group-relative account of law. Part II argues, with reference to the U.S. experience, that multiple groups can simultaneously instantiate the kind of social fact that undergirds law, be it a convention, a social norm, a “shared cooperative activity” (SCA), or something else. At many points in U.S. constitutional history, multiple official or citizen groups, defined along departmental, partisan, regional, state-federal, religious, or other lines, have accepted competing rules of recognition for U.S. law. Part III argues that “law” functions, primarily, as either an explanatory or a normative construct, and that insisting on a single recognitional community for each legal system would be arbitrary, both for explanatory purposes and for normative purposes. Part IV considers the many implications of the group-relative account for U.S. constitutional theory – in particular, for popular constitutionalism. (shrink)

This work emerged from funded research examining collaboration among stake-holder organizations present at three U.S. nuclear weapons complex sites. The authors examine issues such as how and why stakeholder groups form collaborative alliances when dealing with the target organization, what leaders of stakeholder organizations actually think about when collaborating to deal with the target organization, and what outcomes result from the collaboration process. Drawing on stakeholder theory and research in interorganizational collaboration, the authors used an inductive, interview-based methodology to build (...) a model of collaboration among nonprofit stakeholder groups. The model contributes to the descriptive stream of stakeholder theory and, in turn, has implications for the instrumental stream. The model also offers implications for future researchers, leaders of stakeholder alliances, and leaders of target organizations. (shrink)

The monograph shows that in the last 50 years theoretical linguistics remains a compendium of mutually contradicting doctrines on multiple levels: the level of general theories of language, the level of its main constituents (the lexicon, syntax, and the lexical-syntactic interface that connects them), and the lower levels of specific linguistic problems (such as lexical polysemy, grammatical meanings, etc.). The contradictions of contemporary linguistic theories are indicative of a deep crisis. Evolutionary-synthetic theory of language is aimed at overcoming this crisis. (...) It implements a multidisciplinary approach that describes the language a) in evolutionary and ontogenetic development and b) in close interaction with other human subsystems: the mental representation of the world, human activity and social interaction. Language is defined as a dual system developing in ontogeny: 'universal sensory sublanguage + ethnically specific functional sublanguage' where the sensory sublanguage is used to describe the 'visible' world (accessible to the senses), and the functional sublanguage is employed to describe the conceivable world ('comprehended by human mind'). Within the framework of the approach presented, many problems are solved: 1) the cognitive (non-verbal) language for representing language meanings; 2) diversity and unity of languages (using the structure alternative to Chomsky's Universal Grammar); 3) the main (original) function of the language; 4) the cognitive language of thought (its basis is the lexical and grammatical meanings of the sensory sublanguage); 5) dual (functionally prototypical) structure of human categories; 6) mechanisms in the early acquisition of lexical and grammatical meanings; 7) the meaning (assignment) of the syntactic structure of a sentence, etc. The book deals with a wide range of issues related to human cognition, glottogenesis and anthropogenesis, universal cognitive structures for the representation of objects, actions and situations, so it will be of interest not only to linguists, but also to psychologists, anthropologists, sociologists, philosophers. Food charity in the United States has grown into a critical appendage of agro-food supply chains. In 2016, 4.5 billion pounds of food waste was diverted through a network of 200 regional food banks, a fivefold increase in just 20 years. Recent global trade disruptions and the COVID-19 pandemic have further reinforced this trend. Economic geographers studying charitable food networks argue that its infrastructure and moral substructure serve to revalue food waste and surplus labor in the capitalist food system. The (...) political–legal framework undergirding this revaluation process however is still poorly understood. Drawing on a 6-year institutional ethnography of the food banking economy in West Virginia, this paper takes a supply-side approach to examine the material and moral values driving the expansion of food waste recovery as hunger relief. Empirically, it focuses on the laws, contracts and fiscal incentives regulating charitable food procurement at the U.S. Department of Agriculture and Feeding America. The assemblage of government agencies, private businesses and non-profit organizations enrolled into this gift economy at different scales I argue, serves to enclose food waste into a public–private governance structure that regulates food surpluses and ensures these will not disrupt the scarcity logics driving profitability along primary food circuits. These emotions are associated with both military training and with posttraumatic stress among other disorders. We consider the way that these emotions can be experienced after exposure to combat as well as grievous bodily injury, and seek to untangle situations in which they are artifacts of military training and identity rather than symptoms. The data for this article are drawn from interviews and observations with former patients of (...) the US Armed Forces Amputee Patient Care Program at the Walter Reed National Military Medical Center. An experience like hypervigilance is often treated as a symptom of posttraumatic stress disorder (PTSD) or mild traumatic brain injury. Some experts place the number of returning service members with either or both of these disorders in the hundreds of thousands. While some participants in our study have received diagnoses of either PTSD or mild traumatic brain injury, in many cases they experience emotions like hypervigilance, differently. Rather than being troubled by hypervigilance, they experience it as a valued legacy of their military training and an important characteristic that distinguishes them from civilians. (shrink)

The American Institute of certified public accountants (AICPA) has promulgated a Code of Professional Conduct , which has served as the primary ethical standard for public accountants in the United States for more than 20 years. It is now out of date and needs to be replaced with a code of ethics. Just as U.S. generally accepted accounting principles are being migrated toward “principles-based accounting” as part of a convergence with international financial reporting standards, a similar process needs to occur (...) with ethics. This article organizes the primary rules of the AICPA Code around five essential virtues: objectivity, integrity, inquisitiveness, loyalty, and trustworthiness. These virtues correspond to the general principles set forth in the Code of Ethics for Professional Accountants of the International Federation of Accountants (IFAC). From this virtue ethics perspective, various rules of the AICPA Code are critiqued as being inadequate at best, and poorly crafted at worst. The article concludes with the proposition that principles-based ethics serves the profession and the financial reporting process better than the current rules-based approach. (shrink)

1. Introduction The policy of deterrence, at least to avert nuclear war between the superpowers, has been a controversial one. The main controversy arises from the threat of each side to visit destruction on the other in response to an initial attack. This threat would seem irrational if carrying it out would lead to a nuclear holocaust – the worst outcome for both sides. Instead, it would seem better for the side attacked to suffer some destruction rather than to retaliate (...) in kind and, in the process of devastating the other side, seal its own doom in an all-out nuclear exchange. Yet, the superpowers persist in their adherence to deterrence, by which we mean a policy of threatening to retaliate to an attack by the other side in order to deter such an attack in the first place. To be sure, nuclear doctrine for implementing deterrence has evolved over the years, with such appellations as “massive retaliation,” “flexible response,” “mutual assured destruction”, and “counterforce” giving some flavor of the changes in United States strategic thinking. All such doctrines, however, entail some kind of response to a Soviet nuclear attack. They are operationalized in terms of preselected targets to be hit, depending on the perceived nature and magnitude of the attack. Thus, whether U.S. strategic policy at any time stresses a retaliatory attack on cities and industrial centers or on weapons systems and armed forces, the certainty of a response of some kind to an attack is not the issue. This extensive work explores the changing world of religions, faiths and practices. It discusses a broad range of issues and phenomena that are related to religion, including nature, ethics, secularization, gender and identity. Broadening the context, it studies the interrelation between religion and other fields, including education, business, economics and law. The book presents a vast array of examples to illustrate the changes that have taken place and have led to a new world map of religions. Beginning with an introduction (...) of the concept of the "changing world religion map", the book first focuses on nature, ethics and the environment. It examines humankind's eternal search for the sacred, and discusses the emergence of "green" religion as a theme that cuts across many faiths. Next, the book turns to the theme of the pilgrimage, illustrated by many examples from all parts of the world. In its discussion of the interrelation between religion and education, it looks at the role of missionary movements. It explains the relationship between religion, business, economics and law by means of a discussion of legal and moral frameworks, and the financial and business issues of religious organizations. The next part of the book explores the many "new faces" that are part of the religious landscape and culture of the Global North (Europe, Russia, Australia and New Zealand, the U.S. and Canada) and the Global South (Latin America, Africa and Asia). It does so by looking at specific population movements, diasporas, and the impact of globalization. The volume next turns to secularization as both a phenomenon occurring in the Global religious North, and as an emerging and distinguishing feature in the metropolitan, cosmopolitan and gateway cities and regions in the Global South. The final part of the book explores the changing world of religion in regards to gender and identity issues, the political/religious nexus, and the new worlds associated with the virtual technologies and visual media.
